WASHINGTON, March 23, 2025 — The Trump Administration issued a directive Friday imposing additional scrutiny on attorneys representing immigrants in federal and immigration courts, a move critics say will further erode due process in an already strained system.
The memo orders sanctions, heightened reviews, and stricter oversight of legal professionals—a step immigration advocates argue is unnecessary and designed to accelerate deportations by limiting access to counsel. The policy comes amid a surge in expedited removals and the expanded use of federal agencies to detain noncitizens, making legal representation more critical than ever.
Advocates Warn of “Stacked Decks” Against Immigrants
Rebekah Wolf, Director of the American Immigration Council’s Immigration Justice Campaign, condemned the administration’s actions in a statement:
“Research consistently shows that due process is only possible when individuals have trained attorneys guiding them through our broken and convoluted immigration system. Yet most noncitizens already face these proceedings alone—and now, the Trump administration is actively working to deny even more people legal help, all to inflate deportation numbers.”
Wolf warned that the policy deliberately targets vulnerable families, allowing immigration enforcement to operate without accountability. “Instead of dismantling due process, we should be reforming the system to ensure fairness, efficiency, and transparency for everyone involved,” she added.
Threat to Pro Bono Representation
With legal representation already scarce in immigration courts, pro bono attorneys and volunteers play a crucial role in helping immigrants navigate complex cases—often at no cost. Advocates argue the new memo aims to intimidate these lawyers, discouraging them from taking on cases.
“This is a blatant attempt to punish attorneys who defend immigrants’ rights,” Wolf said. “Stripping away basic legal protections will devastate people who have few avenues for justice.”
